GUIDELINE B DENIAL – CLEARANCE GRANTED
Department of Defense, Defense Office of Hearings and Appeals (DOHA) notified contractor employee by way of a Statement of Reasons (SOR) that it was unable to grant the employee access to classified information.   Employee retained Burke Law to respond to the SOR and to request a hearing before an Administrative Judge for a determination.   Client mitigated the Government’s concerns under Guideline B (Foreign Influence).   Specifically, the Client mitigated all concerns regarding his mother and father residing in and being citizens of Egypt; his brother residing in and being a citizen of Kuwait; and his sisters residing in Saudi Arabia and Egypt and being citizens of Egypt.   Burke Law presented witnesses, exhibits, testimony, and the entirety of the applicant’s case to the Administrative Judge for a determination at the DOHA hearing.  Result: SECURITY CLEARANCE GRANTEDADMINISTRATIVE JUDGE DETERMINED IT IS IN THE INTEREST OF NATIONAL SECURITY FOR APPLICANT TO HAVE ACCESS TO CLASSIFIED INFORMATION.
